Terms of Service

Agreement

By using Abby ("the Service"), you agree to these terms. If you're using Abby on behalf of a clinic or organisation, you confirm you have authority to bind that organisation to these terms.

What Abby does

Abby is an SMS interpretation service that:

• Reads incoming SMS replies to Cliniko appointment reminders
• Uses AI to interpret whether the patient confirmed, cancelled, or needs follow-up
• Displays confirmation status in a Chrome extension
• Posts interpreted messages to appointment notes in Cliniko

Abby is read-only — it cannot send SMS messages, modify appointments, or access other parts of your Cliniko account.

Requirements

To use Abby, you need:

• An active Cliniko account with SMS appointment reminders enabled
• Google Chrome browser (for the extension)
• To be located in Australia, New Zealand, or the United Kingdom

Abby only works with Cliniko's built-in SMS reminders. Third-party SMS platforms and manual SMS are not supported.

Your responsibilities

You agree to:

• Keep your account credentials secure
• Use Abby only for legitimate clinic operations
• Ensure you have appropriate consent from patients to process their SMS replies
• Review appointments flagged as "needs attention" rather than relying solely on automated interpretation

Accuracy and limitations

Abby's AI interpretation is highly accurate but not infallible. You should:

• Treat Abby as an assistant, not a replacement for human judgement
• Review the original message in appointment notes when in doubt
• Have a process for handling missed or misinterpreted messages

We are not liable for missed appointments or scheduling issues arising from AI interpretation errors.

Subscription and billing

Free trial

New accounts include a 14-day free trial. No credit card is required to start. At the end of the trial, you'll need to subscribe to continue using Abby.

Pricing

Subscription pricing is listed on our pricing page. Prices may change with 30 days notice to existing subscribers.

Payment

Subscriptions are billed monthly or annually via credit card. Failed payments will be retried, and accounts with persistent payment failures may be suspended.

Cancellation

You can cancel your subscription at any time from your account settings. Access continues until the end of your current billing period. We don't offer refunds for unused time on monthly plans. Annual plans are non-refundable but you retain access until the period ends.

Availability

We aim for high availability but don't guarantee uninterrupted service. Abby syncs with Cliniko every 15 minutes — temporary outages may delay colour updates but won't affect your Cliniko data.

Privacy

Your privacy matters. See our Privacy Policy for details on data collection, storage, and security.

Intellectual property

Abby, including its AI models, software, and branding, is owned by us. Your subscription grants you a licence to use the Service — it doesn't transfer any ownership.

Your clinic data remains yours. We claim no ownership of your Cliniko data or patient information.

Termination

We may suspend or terminate accounts that:

• Violate these terms
• Have persistent payment failures
• Are used for fraudulent or illegal purposes

We'll provide notice before termination where reasonable.

Liability

To the extent permitted by law:

• Abby is provided "as is" without warranties of any kind
• We're not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the fees you've paid in the past 12 months

Nothing in these terms limits liability for fraud, gross negligence, or anything that can't be excluded by law.

Governing law

These terms are governed by the laws of New Zealand. Disputes will be resolved in New Zealand courts.

Changes

We may update these terms. Significant changes will be notified by email 30 days before taking effect. Continued use after changes constitutes acceptance.
